The essence of artistic expression extends beyond mere talent; it intertwines with a strategic understanding of the business dimensions surrounding one's craft. In this digital era, once an artist unveils their creation to the world, control over its usage becomes a delicate negotiation. Savvy entities often exploit legal intricacies. However, artists possess a formidable defense through a comprehensive understanding of their rights and the legal frameworks available.
Copyrights emerge as a powerful shield, providing artists with exclusive rights to reproduce, distribute, and display their work. Intellectual Property Rights (IPR) further fortifies this defense, recognizing the economic and moral rights inherent in creative endeavors. Just like every invention or
sector before it, the evolving AI sector needs to be regulated. The acceleration of technology prompts a
reevaluation of artistic processes; in fact, most processes as pertains to
other sectors, where smart alternatives challenge the established norms. The
dynamics of the market are poised for transformation, and stakeholders must
navigate this landscape with a keen understanding of the diverse values each
approach brings. In this particular case, the question arises: does the art
market possess the breadth to embrace both the meticulous craftsmanship of
traditional artists and the rapid, intelligent outcomes generated by AI?
To ensure fairness and foster innovation, the legal structure should encompass a mechanism for sharing the benefits of AI-generated art among all those who have contributed to its creation. One challenge is the issue of authorship. In traditional art, the artist is clearly the person who created the work. However, in AI art, design or writing, the authorship is often more ambiguous. It is often difficult to say who the true artist is: the person who created the AI model, the person who provided the data to the model, or the AI model itself?
Another challenge which has been mentioned several times since the beginning of this article is the issue of copyright. In traditional art, the artist owns the copyright to their work and determines how such work is used. However, in AI art, the copyright is often more complex. It is not always clear who owns the copyright to an AI-generated work, and there is a risk of copyright infringement if the work is not used with permission.

agreements, profit-sharing schemes, or some form of professional
statutory entitlement or compensation. In addition, there is also an urgent need to
establish a resilient regulatory framework addressing ethical concerns,

a multi-faceted approach is imperative. Implementing stringent disclosure
requirements mandating tech/AI experts to transparently communicate their
financial interests, affiliations, and potential conflicts would foster
accountability. The regulatory body must be independent with interdisciplinary
expertise that would ensure comprehensive oversight and swift response to
emerging ethical challenges. Instituting regular, rigorous audits of algorithms
